THE
CONDOMINIUM LAW
The condominium
of shares, or horizontal property, provides the opportunity to divide
the mother property in filial shares that would be regulated by a
set of gated community Rules. Each Owner is an exclusive owner of
its filial share, and a joint owner of the communal property. Each
Owner will accredit its own condition with the respective public deed
of acquisition.
The Owners will be able to use, to tax, and to alienate their own individual property, with the limitations and prohibitions of the Regulating Rules of the gated community Property, the constitutive deed, and the Rules that are imposed to it. In case of sale, assignment or transference of other kind, of a filial share or part of it, the one who transfers should communicate it to the Administrator. In the conveyance deed, the new Owner should manifest that he knows and accepts the Rules. It is the new Owner's responsibility to accredit himself as such before the Administrator.
The running and
administrating parts of the gated community are constituted by (i)
the Owner's Assembly, (ii) the Management, and (iii) the Construction
Commission. The Owner's Assembly is the supreme part of the gated
community and it will resolve the matters of common interests that
are submitted to its knowledge. In the gated community there's the
communal area of general use, clear as well as constructed, which
is composed by the following areas: (A) Constructed Common Area: it
includes: (i) Guard's cottage,(ii) Garbage Disposal Area, (iii) Area
destined to paths, (iv) Terrace and Hut, (v) Storage Area. (B)Clear
Common Area: includes: (i) paved Areas (ii) Sidewalks (iii) green
areas of access.
Each Owner is obligated to contribute to the common expenses necessary for the good functioning of the gated community. The common expenses will be supported by all the Owners in the proportion that results from applying the amount of common expenses to the percentage that corresponds to each filial share in accordance to the constitutive deed of the gated community.
